Trouble for S. 510?
For those of you with limited knowledge of the Constitution, the House is given the power to originate spending and tax legislation, not the Senate.
But since this is a Senate bill, it reportedly is running into problems in the House of Representatives, what’s known as the “Blue Slip” process, and could be blocked by members of the tax-writing Ways and Means Committee, who jealously guard their power to originate tax legislation over the Senate.
Here is the language involved:
SEC. 107. AUTHORITY TO COLLECT FEES. 15 (a) FEES FOR REINSPECTION, RECALL, AND IMPORTATION ACTIVITIES.–Subchapter C of chapter VII (21 17 U.S.C. 379f et seq.) is amended by adding at the end the 18 following:
“PART 6–FEES RELATED TO FOOD”SEC. 743. AUTHORITY TO COLLECT AND USE FEES,” and it goes from there.
This is very basic stuff here. The bill did not originate in the House. It raises revenue. You can’t do that.
